Terms of Service

By purchasing, accessing, activating, or using WINMO (a mobile service membership offered by Club Mobile LLC DBA Win Mobile), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not purchase or use the service.
1. Eligibility (18+ Only)
WINMO is intended strictly for individuals who are at least eighteen (18) years of age. By purchasing, activating, or using WINMO, you represent and warrant that you are at least 18 years old. Access by minors is strictly prohibited.
2. Nature of Service
WINMO is a mobile service membership that includes access to digital content and other member benefits. Your membership may include:
- Mobile wireless service on a nationwide network
- eSIM activation and wireless connectivity
- Unlimited talk and text
- Data service subject to applicable plan thresholds
- Mobile hotspot data included with all plans
- International features where included
- Digital content, commentary, analysis, educational materials, and informational resources
- Community access and member benefits made available by Win Mobile from time to time
WINMO does not provide financial advice, investment advice, legal advice, tax advice, gambling services, betting services, wager placement services, or guaranteed outcomes of any kind. Any digital content included with your membership is provided solely for informational and entertainment purposes.
3. Mobile Service Terms
WINMO provides eSIM-based mobile wireless service through a nationwide wireless network. You acknowledge and agree that:
- Mobile service is the primary product being purchased
- Service availability depends on network coverage, carrier limitations, device compatibility, geographic location, and other factors outside WINMO's control
- Coverage, speeds, latency, uptime, and performance are not guaranteed
- You are responsible for confirming your device is eSIM-compatible before purchasing
- International roaming availability varies by country and device
- Network performance may vary due to congestion, maintenance, signal strength, and other conditions
- WINMO may suspend, limit, or terminate service when required for operational, legal, fraud-prevention, or network-management reasons
- Activation times are estimates only. WINMO does not guarantee immediate activation, uninterrupted service, successful device compatibility, or successful number transfer
All WINMO plans include mobile hotspot data as a separate allowance that does not count against your plan's high-speed data threshold. WINMO Junior includes 5GB, WINMO Essential includes 10GB, and WINMO Max includes 25GB of mobile hotspot data per billing cycle. Once your hotspot allowance is exhausted, hotspot speeds will reduce to 128Kbps for the remainder of the billing cycle.
Service is subject to applicable FCC regulations, including those governing Customer Proprietary Network Information (CPNI).
4. Data Usage & Fair Use Policy
4.1 High-Speed Data Allowances
Each WINMO plan includes a monthly data allowance. Speed reduction and data availability behave differently depending on the plan:
- WINMO Junior: Up to 5GB at full 5G speeds, then reduced to 512Kbps from 5GB to 10GB. Data service is suspended after 10GB of total data usage for the remainder of the billing cycle. Junior is a hard-cap plan and does not include any data beyond the 10GB total threshold.
- WINMO Essential: Up to 15GB at full 5G speeds, then reduced to 512Kbps from 15GB to 30GB, then reduced to 128Kbps for the remainder of the billing cycle.
- WINMO Max: Up to 25GB at full 5G speeds, then reduced to 512Kbps from 25GB to 50GB, then reduced to 128Kbps for the remainder of the billing cycle.
Your applicable thresholds are determined by the plan selected at purchase. Talk and text remain available on all plans regardless of data status, subject to the fair use limits in Section 5.
4.2 Speed Reduction & Data Suspension After Threshold
WINMO Essential and WINMO Max: Once your plan's full-speed data threshold has been reached during a billing cycle, data speeds will reduce to 512Kbps until you reach your secondary threshold, after which speeds will reduce to 128Kbps for the remainder of that billing cycle.
WINMO Junior: Once 5GB of full-speed data has been used during a billing cycle, data speeds will reduce to 512Kbps for the next 5GB. After 10GB of total data usage, data service will be suspended for the remainder of the billing cycle. Talk, text, and access to emergency services remain available. To restore data service before the next billing cycle, you may upgrade to a higher-tier plan if such option is offered by WINMO.
At 512Kbps, the following remain functional:
- SMS and messaging apps (iMessage, WhatsApp)
- Navigation (Google Maps, Waze)
- Email and standard web browsing
- Music streaming
- Standard-definition social media browsing
At 512Kbps, the following may be slow or unreliable:
- HD video streaming
- Video calling at high quality
- Large file downloads
At 128Kbps (Essential and Max only), the following remain functional:
- SMS and messaging apps (iMessage, WhatsApp)
- Basic navigation (Google Maps, Waze)
- Email (text only)
- Basic web browsing
At 128Kbps, the following will not function reliably:
- Video streaming of any quality
- Social media with video or images
- Video calling or conferencing
- Large file downloads or uploads
- Cloud backups
- Online gaming
4.3 Unlimited Data Plans
WINMO Max includes unlimited talk and text. Data access remains subject to the tiered speed structure described above: full speed up to 25GB, 512Kbps from 25GB to 50GB, and 128Kbps after 50GB for the remainder of the billing cycle. Additional high-speed data may be available for purchase if offered by WINMO.
4.4 Network Management & Deprioritization
To maintain network quality for all customers, WINMO may employ reasonable network management practices. During periods of network congestion, customers who have consumed significant amounts of data may experience temporary speed reductions, even before reaching their plan threshold. Any such network management practices are applied for legitimate operational purposes and may vary based on network conditions.
4.5 Billing Cycle Reset
Data thresholds reset at the beginning of each billing cycle. Unused high-speed data does not roll over unless explicitly stated otherwise.
4.6 Prohibited Data Usage
You may not:
- Operate servers or commercial routing services through the network
- Generate excessive automated traffic
- Attempt to circumvent throttling or network management systems
- Use the service in a manner that negatively impacts network performance
- Engage in unlawful activity through the network
Violations may result in suspension or termination without refund.
4.7 Emergency Services
Data speed limitations and data suspension under this Section do not affect access to emergency communications, including 911 services, subject to applicable network and device limitations.
5. International Services
All WINMO plans include the following international features at no additional charge:
- International data roaming as a separate data allowance that does not count against your domestic high-speed data allotment
- Unlimited calls and texts to Mexico and Canada
- Calls and texts from the US to Mexico and Canada included in your plan at no extra cost
5.1 Voice Fair Use
All WINMO plans include a fair use limit of 450 minutes per billing cycle for calls to Mexico and Canada combined. Usage beyond 450 minutes may be subject to additional charges or restrictions. Domestic US calls and texts are always unlimited and are not subject to this fair use limit.
5.2 International Data Roaming
International data roaming is included on all WINMO plans as a separate 500MB high-speed data allowance per billing cycle and does not count against your domestic high-speed data allotment. Once your 500MB international roaming allowance is exhausted, roaming data speeds will reduce to 128Kbps for the remainder of the billing cycle. Win Mobile is not responsible for service availability or quality in international markets as these are subject to the coverage of partner networks. A current list of supported countries for international calling and worldwide roaming is maintained at winmobile.us/international.html and may be updated periodically.
5.3 Worldwide Roaming Add-On
The Worldwide Roaming add-on ($10/month) enables international voice, text, and data usage beyond the 500MB included on every plan. Usage is metered and billed by country zone, with rates varying based on the destination and partner network. Win Mobile organizes supported countries into pricing zones; rates within each zone may change without notice based on partner network pricing.
When you reach 80% of your consumption budget, you will automatically receive a top-up request from Win Mobile. If a top-up is not added, service will pause when you reach 100% of your consumption budget and remain paused until additional credit is applied or until the start of your next billing cycle, whichever comes first. There are no fair-use restrictions or maximum roaming-duration limits beyond the consumption budget mechanism described above. 6. Taxes and Fees
Your monthly service charge does not include applicable taxes and fees, which are calculated based on your billing address and plan. Taxes and fees are itemized at checkout and on your monthly statement and may include:
- Federal Universal Service Fund (USF)
- State and local taxes
- E911 and Telecommunications Relay Service (TRS) fees
These charges are mandated by federal, state, and local governments and are subject to change. WINMO does not retain any portion of these charges.
7. Digital Content (Included Member Benefit)
Digital content is provided as a supplemental member benefit. You acknowledge that:
- All content is for informational and entertainment purposes only
- Content may consist of opinions, commentary, analysis, observations, educational materials, and general information
- Content may change at any time without notice
- No content is guaranteed to be accurate, complete, current, predictive, or profitable
- You will not rely upon content as financial, investment, legal, tax, gambling, betting, or professional advice
- Any decisions made based on content are made solely at your own risk
- WINMO is not responsible for any gains, losses, damages, or outcomes resulting from your use of content
8. No Guarantees / Results Disclaimer
WINMO makes no guarantees of any kind, express or implied, regarding:
- Wireless service performance
- Network availability
- Coverage quality
- Data speeds
- Content accuracy
- Outcomes or results
- Profitability
- Success of any kind
Any examples, testimonials, illustrations, references to prior results, or historical performance are provided solely for illustrative purposes and do not guarantee future results. Past results do not predict future outcomes.
9. Billing, Final Sale & Refunds
Except as expressly provided in Section 9.1 (7-Day Money-Back Guarantee) below, all sales are final.
By completing your purchase, you acknowledge and agree that:
- Mobile service is activated immediately or made available immediately after purchase
- Digital content access is provided immediately after purchase where applicable
- No refunds, credits, prorations, reversals, or chargebacks will be issued except as provided in Section 9.1 below or where required by applicable law
Except as provided in Section 9.1 below, this applies regardless of:
- Dissatisfaction with service
- Dissatisfaction with content
- Coverage issues
- Device incompatibility
- Failure to use the service
- Failure to cancel before renewal
- Failure to achieve desired results
- Perceived service quality
Customers agree to contact WINMO regarding billing concerns before initiating a payment dispute whenever reasonably possible. WINMO reserves the right to contest chargebacks or payment disputes using account records, activation logs, service records, network usage records, transaction records, communications, and evidence of acceptance of these Terms.
9.1 7-Day Money-Back Guarantee
New customers may request a one-time refund of their first month’s plan charge if all of the following conditions are met:
- The refund is requested within seven (7) days of the original purchase date;
- The account has used less than one (1) gigabyte (1 GB) of data during that period; and
- The customer is not satisfied with the service.
To request a refund, contact support@winmobile.us within the 7-day window. The following are non-refundable: taxes, regulatory and government fees, and any one-time SIM or activation fees. Add-on charges and any usage-based or overage charges are not eligible. Limit one (1) refund per customer, household, and payment method. Approved refunds are issued to the original payment method and may take 5–10 business days to process. Accounts showing 1 GB or more of data usage, or requests made after the 7-day period, do not qualify. WINMO reserves the right to deny refunds in cases of suspected fraud or abuse.
10. Subscription Terms
Subscriptions automatically renew on a monthly basis at the recurring rate disclosed during checkout. By subscribing, you authorize WINMO to charge your selected payment method on a recurring monthly basis until canceled.
You are solely responsible for canceling your subscription before the next monthly renewal date if you do not wish to continue service. Failure to cancel before renewal does not create eligibility for refunds or credits.
11. Cancellation Effects
You may cancel your subscription at any time through your account portal, by logging in via the "Login" link on the WINMO homepage, or by writing to support@winmobile.us. Cancellation requests submitted by email are processed during normal business hours.
If your membership is canceled, terminated, suspended, or expires:
- Mobile service may terminate immediately or at the end of the billing cycle
- Access to digital content and member benefits may terminate immediately
- Your phone number may become subject to applicable carrier porting and reassignment rules
- No refunds or prorated credits will be issued
12. Number Porting
WINMO is not responsible for delays, interruptions, failed transfers, loss of service, loss of numbers, or other issues arising from number porting requests submitted by customers, prior carriers, third-party carriers, or telecommunications providers. Customers are responsible for providing accurate account information and porting credentials. Porting timelines are estimates only and are not guaranteed.
13. User Responsibility & Assumption of Risk
You are solely responsible for:
- Your use of the service
- Your device compatibility
- Your decisions and actions
- Compliance with all applicable laws
You expressly assume all risks associated with your use of WINMO and any related content or services.
14. Prohibited Use
You may not:
- Copy, distribute, reproduce, or resell WINMO content
- Share account credentials
- Use the service unlawfully
- Misrepresent WINMO or its services
- Reverse engineer or interfere with WINMO systems
- Circumvent technical restrictions
- Abuse network resources
- Engage in fraud or deceptive practices
Violations may result in immediate suspension or termination without refund.
15. Release of Claims
To the fullest extent permitted by law, you release and waive any and all claims, demands, liabilities, damages, losses, costs, and expenses arising from or related to:
- Use of WINMO services
- Wireless service performance
- Network coverage
- Content provided through the membership
- Decisions made using information accessed through WINMO
This release applies to Club Mobile LLC DBA Win Mobile and its owners, members, managers, employees, contractors, affiliates, successors, and assigns.
You expressly waive the benefits of California Civil Code Section 1542, which provides that a general release does not extend to claims the releasing party does not know or suspect to exist at the time of executing the release.
16. Hold Harmless Agreement
You agree to hold harmless Club Mobile LLC DBA Win Mobile and its owners, members, managers, employees, contractors, affiliates, successors, and assigns from any claims, liabilities, losses, damages, costs, and expenses arising from:
- Your use of the service
- Your use of content
- Your violation of these Terms
- Your misuse of the network or services
17. Indemnification
You agree to defend, indemnify, and hold harmless Club Mobile LLC DBA Win Mobile and its affiliates from any third-party claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys' fees, arising from your use of the service or violation of these Terms.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINMO SHALL NOT BE LIABLE FOR:
- INDIRECT DAMAGES
- INCIDENTAL DAMAGES
- CONSEQUENTIAL DAMAGES
- LOST PROFITS
- LOST DATA
- BUSINESS INTERRUPTION
- COVERAGE GAPS
- NETWORK OUTAGES
- SERVICE INTERRUPTIONS
If liability is found despite the foregoing limitations, WINMO's total liability shall not exceed the amount paid by you during the current billing period.
19. Termination Rights
WINMO may suspend, restrict, or terminate service at any time for:
- Violations of these Terms
- Fraud concerns
- Abuse
- Nonpayment
- Compliance requirements
- Operational reasons
Termination does not entitle you to any refund.
20. Modifications to Service or Terms
WINMO may modify services, features, pricing, membership benefits, data allowances, network policies, and these Terms at any time. Continued use of the service after modifications become effective constitutes acceptance of the revised Terms.
21. Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, WINMO services, billing, subscriptions, wireless service, digital content, marketing communications, or the relationship between you and WINMO shall be resolved exclusively through final and binding arbitration rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies.
The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time the claim is filed. If AAA is unavailable or declines to administer the arbitration, the parties shall use JAMS under its Streamlined Arbitration Rules and Procedures. If neither AAA nor JAMS is available, a court of competent jurisdiction shall select an arbitrator. Arbitration shall be conducted on an individual basis only.
You and WINMO each waive any right to participate in a class action, collective action, mass action, representative action, or class-wide arbitration.
No arbitrator shall have authority to consolidate claims of multiple individuals or preside over any form of representative or class proceeding.
The arbitrator shall have exclusive authority to resolve disputes concerning the interpretation, applicability, enforceability, or formation of this arbitration provision.
If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in full force and effect to the maximum extent permitted by law.
22. Governing Law & Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms, the services provided by WINMO, or the relationship between the parties shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida. You consent to the personal jurisdiction of such courts and waive any objection based on venue or forum non conveniens.
23. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in full force and effect.
24. SMS, Text Messaging & Email Marketing Consent
By providing your mobile number and opting in (including through any signup, lead, or checkout form on our websites), you consent to receive account notifications, service alerts, promotional messages, and recurring marketing communications from Club Mobile LLC DBA Win Mobile at the number provided, including messages sent using an automatic telephone dialing system or similar automated technology. You acknowledge and agree that:
- Consent is not a condition of any purchase of goods or services
- Message frequency varies
- Message and data rates may apply
- You may opt out of marketing texts at any time by replying STOP
- Reply HELP for assistance
- Carriers are not liable for delayed or undelivered messages
- Transactional and account-related communications may continue where permitted by law
If you provide your email address, you likewise consent to receive promotional and marketing emails from Win Mobile. You may unsubscribe from marketing emails at any time using the unsubscribe link included in every such email. All communications and the information you provide are handled in accordance with our Privacy Policy.
